Subject: 9609/Amend #9585 Retirement Incentive Date: Mon, 4 Jun 1990 17:11:00 -0500 ORDINANCE NO. 9609 AN ORDINANCE TO AMEND ORDINANCE NO. 9585, ENCAPTIONED AS SET FORTH BELOW, THE BUDGET ORDINANCE, SO AS TO PROVIDE FOR A RETIREMENT INCENTIVE PLAN. ______________________________ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That: SECTION 1. That Ordinance No. 9585, encaptioned: "AN ORDINANCE TO PROVIDE REVENUE FOR THE FISCAL YEAR BEGINNING JULY 1, 1991, AND ENDING JUNE 30, 1992, AND APPROPRIATING SAME TO THE PAYMENT OF EXPENSES OF THE MUNICIPAL GOVERNMENT; FIXING THE RATE OF TAXATION ON ALL TAXABLE PROPERTY IN THE CITY, AND THE TIME TAXES AND PRIVILEGES ARE DUE, HOW THEY SHALL BE PAID, WHEN THEY SHALL BECOME DELINQUENT; AND PROVIDING FOR INTEREST AND PENALTY ON DELINQUENT TAXES AND PRIVILEGES." be and the same is hereby amended so as to amend Section 7 by adding new subsections 7(d) through (g) as follows: (d) Any full-time employee of the City who has more than one full year of service shall be eligible for an "early retirement incentive." This shall not include employees in any jointly funded agency unless authorized by such agency and the agency pays the amounts due to the employee from its budget. (e) The "early retirement incentive" shall be calculated upon the basis of one (1) week's pay for each full year of the employee's total full years service next preceding retirement or service credited under either the General Pension Plan or the Firemen and Policemen's Insurance and Pension Fund not to exceed twenty-five (25) weeks. Payments to the employee as an retirement incentive shall be credited to funds appropriated to the respective departments for salaries, wages and fringe benefits with the balance, if any, appropriated from the unencumbered fund balance. (f) That to be eligible for the "early retirement incentive" the employee must make an application to the Personnel Director upon forms to be provided by the Personnel Director on or before August 30, 1991, which shall establish a retirement date on or before December 31, 1991. (g) Employees who retire in December 1991 shall be paid the incentive in January 1992. Those employees who retire prior to December 1991 shall be paid in full within thirty days following retirement providing that such payment shall not cause them to earn more money than they would have otherwise earned from the City during 1991 in which event they shall be paid in 1991 amounts equivalent to what they would have otherwise earned in 1991 with the balance payable in January 1992. SECTION 2. Payments made to employees as an "early retirement incentive" shall not constitute wages or payments in lieu of wages and shall not be subject to withholding for or payment of pension contributions. SECTION 3. This "early retirement incentive" shall apply to all employees who were employed on August 1, 1991; providing that they were not terminated for cause or they otherwise left the city's employment for reasons not related to this incentive. Employees who accept this incentive shall not hereafter be eligible for employment by the city. SECTION 4. That if any section, sentence or word of this ordinance should be declared invalid by a court of competent jurisdiction, such holding shall not affect the remaining sentences, sections, or words of this ordinance, but the same shall remain in full force and effect. SECTION 5. That this Ordinance shall take effect immediately, being a matter of urgency and required by the public peace, health or safety.
